LOS ANGELES, Calif.-Alexander Cody Smith, 30, of Canoga Park, was charged with three felony counts of workers ‘ compensation insurance fraud after reportedly misrepresenting previous accidents, collecting over $38,000 from the insurance provider of his employer in undeserved medical treatments and temporary disability benefits.
As he was lifting a crate, Smith, while working for Engen Enterprises Inc., said he hurt his back on March 16, 2018. Smith complained of back pain to his treating physician over the course of his medical care and later added neck pain symptoms to the argument. Smith denied any prior injuries or concerns about his back, specifically his thoracic or lumbar spine, according to his claims and his doctor’s medical report.
According to subpoenaed records of his former health care provider and rehabilitation specialists, an audit by the California Department of Insurance uncovered a history of medical problems relating to both Smith’s neck and back, which allegedly started in October 2015. The documents indicate that Smith received medical attention from February 25, 2017, to March 13, 2018, and Smith reported feeling depressed due to his pain at this time, according to the records. This was just three days before the date on which he said he was injured when raising the box at work.
The Department’s inquiry found that his previous back injuries was misrepresented by Smith. This was done to continue care for his continuing illness, which was not work-related. Smith submitted inaccurate information to his employer’s insurance provider about his past existing conditions, which resulted in costly and needless medical examinations, medications, and temporary disability compensation at a cost of $38,746.
On October 28, 2020, Smith was arrested and arraigned on October 30, 2020. This case is being investigated by the Los Angeles County District Attorney’s Office.
